1. SCOPE OF AGREEMENT

Please review these Terms of Service ("Agreement", "Terms of Service") attentively before accessing https://www.samsaratribe.ae ("the Site") managed by Samsara Yoga Center LLC ("us", "we", "our", “Samsara Tribe”, “the Studio”, or “Samsara Yoga Tribe”), encompassing our mobile applications (“Apps”), services provided at our studios, and any other services associated with these Terms (collectively referred to as the “Services”).

This Terms of Service document is an agreement between you and Samsara Yoga Center and sets forth the legally binding terms and conditions for your use of the Services. The Terms incorporate by reference our Privacy Policy, available at PRIVACY POLICY (the Terms of Service and Privacy Policy are collectively referred to as the “Agreement”).

By engaging with the Services, which includes activities such as visiting the Site, downloading the App(s), or contributing content, you are consenting to be bound by the Terms. Your usage of the Services is permissible only upon your acceptance of all relevant laws and the Terms. It is advisable to thoroughly review and retain a copy of the Terms. Should you disagree with them, it is recommended that you exit the Site or App and cease using the Services promptly.

2. GENERAL

THE STUDIO

I. All service purchases (including classes, workshops, and events) are non-refundable.

I. Kindly ensure arrival at least ten minutes before the scheduled class.

III. To facilitate the transition for the subsequent class, we kindly request that you vacate the room within 5 minutes after the conclusion of your session.

IV. The minimum age requirement for most yoga classes is 16 years. Individuals aged between 16 and 18 must have a legal guardian sign their waiver as a form of consent. For participants under 16 years of age, please consult with us to explore suitable yoga class options.

V. Each student must maintain a distinct online account linked to a unique email address, barring the sharing of email addresses among friends and family members.

VI. Discounts on class packages, introductory offers, or unlimited packages will not be granted unless approved by management.

VII. Samsara Tribe provides yoga mats, blocks, bolsters, straps, and towels for class use. Students are advised to remain hydrated during sessions and to stow away all equipment post-class.

VIII. Prior to each class, attendees are required to check in at the reception desk or through our mobile App if they are within a 100-meter radius of the Studio.

IX. Payment is mandatory upon booking. Access to classes, workshops, or events will be denied to students who have not made payment, except in cases of free or donation-based classes.

X. For safety, late entry beyond 10 minutes after the class commences is prohibited, and exiting before the class concludes is strongly discouraged.

XI. Samsara Tribe does not assume responsibility for the safekeeping of personal belongings. Clients bring items to the center at their own risk.

XII. While every attempt will be made to adhere to the class schedule, unforeseen circumstances may necessitate changes or cancellations. Clients are advised to consult the online schedule for the most current information. Samsara Yoga Center LLC is not obligated to reimburse, transfer, or provide compensation for classes delayed, altered, or cancelled.

XIII. By participating, you confirm that a qualified medical professional has assessed your physical health within the last six months, attesting to your capability to engage in all yoga classes. Samsara Yoga Center LLC bears no responsibility for any injuries or illnesses resulting from class participation.

XIV. Students are accountable for informing instructors of any prior injuries, illnesses, or conditions that could influence their practice.

XV. By attending any class, you acknowledge and assume the inherent risk of personal injury or accidents, demonstrating your acceptance of such risk.

XVI. It is imperative that you adhere to all directives provided by Samsara Yoga Center LLC and your instructors. Any deviation from these instructions is done at your own risk and may result in injury.

XVII. By participating in classes at Samsara Yoga Centre LLC, you consent that neither you, nor your heirs, assigns, or legal representatives, will pursue legal action or assert any claims against Samsara Yoga Centre LLC or its members for personal injury, property damage or loss, or wrongful death, except in cases of gross or willful negligence, in accordance with relevant laws.

XVIII. Disputes exclude personal injury claims or claims regarding lost, stolen, or damaged property.

XIX. It is advisable for students to maintain proper hydration during classes.

XX. The use of cell phones is prohibited within the Serenity Yoga room.

XXI. Footwear is not permitted within the Serenity Yoga area.

XXII. Samsara Yoga Centre LLC retains the right to deny entry at the discretion of the management.

XXIII. Terms, conditions, and fees are subject to alteration without prior notice.

XXIV. Upon class booking, you automatically accept the aforementioned terms and conditions.

PRODUCTS

I. Product purchases are eligible for a refund only if returned in new and unused condition within 14 days of purchase.

II. Prices of our products are subject to change without prior notice.

III. Samsara Yoga Centre LLC retains the authority to discontinue any product at its discretion.

IV. We do not guarantee that the quality of any products, services, information, or other materials acquired will necessarily meet your expectations.

3. CHANGES TO THIS AGREEMENT

You have the option to review the most up-to-date version of the Terms of Service on this page. We retain the right, at our discretion, to amend, modify, or substitute any section of these Terms of Service by publishing updates and revisions on our website or applications. It is incumbent upon you to periodically check our website or applications for any modifications. Your ongoing utilization or entry to our website, applications, or services subsequent to the announcement of alterations to these Terms of Service implies your acceptance of said modifications. Should you disagree with any of these Terms or their modifications, kindly refrain from using, accessing, or continuing to access the Services, and cease any usage of the Services promptly.

4. ACCESSING SERVICES AND ACCOUNT SECURITY

To utilize the Services, you may need to furnish specific details or other relevant information. It is imperative, as a prerequisite for using the Services, that all information submitted to us is accurate, up-to-date, and comprehensive. Non-compliance with this requirement may lead to the discontinuation of your access to the Services.

By accessing this site, you affirm that you have reached the age of majority in your place of residence or that you have obtained the necessary consent if you are the legal guardian of a minor who intends to use the Service. Furthermore, your usage of the Services signifies that you are at least 16 years old, and if aged between 16 and 18, your parent or guardian has authorized your acceptance of the Terms of Service and utilization of the Services.

Periodically, access to certain or all aspects of the Services, encompassing studio classes, the Site, and App(s), may be restricted.

To utilize certain services offered on the Site and App(s), you are required to establish an account. It is imperative that you do not utilize another individual's account. By agreeing, you acknowledge that you bear sole responsibility for any activities conducted under your account. Furthermore, you commit to maintaining the security and confidentiality of your account password and undertake to promptly inform us of any security breaches or unauthorized account usage.

5. UNAUTHORISED USAGE

You may utilize the Services exclusively for lawful purposes and in compliance with these Terms. It is agreed that the Services shall not be used:

For any illicit purposes that may contravene applicable federal, state, local, or international laws or regulations.
To engage in any behavior that hinders or obstructs the utilization or enjoyment of the Services by others, or that, as determined by us, could jeopardize our interests or the interests of other individuals using the Services, thereby potentially exposing them to legal liability.
Furthermore, you are prohibited from:
Infringing upon our intellectual property rights or the intellectual property rights of others.
Engaging in activities such as harassment, abuse, insults, harm, defamation, slander, disparagement, intimidation, or discrimination based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
Initiating or participating in any sexual activities on the premises.
Providing false or misleading information.
Using the Services for commercial purposes.
Employing the Services in a manner that could disrupt, overload, impair, or damage the Site, mobile app, or impede any other party’s use of the Services.
Employing any robot, spider, or other automated means to access the Service.
Introducing viruses, trojan horses, worms, logic bombs, or any other malicious or technologically harmful material.
Distributing unsolicited promotional or commercial content or soliciting other individuals using the Services for commercial purposes.
Attempting to interfere with the proper functioning of the Service.
Uploading or transmitting viruses or any other form of malicious code that could impact the functionality or operation of the Service, related websites, other websites, or the Internet.
Collecting or tracking the personal information of others.
Engaging in spamming, phishing, farming, pretexting, spidering, crawling, or scraping.
Using the Service for obscene or immoral purposes or to circumvent the security features of the Service, related websites, other websites, or the Internet.

We retain the right to cease your use of the Service or any related website for violation of any of the aforementioned prohibited actions.

6. STUDIO POLICIES, RULES, AND REGULATIONS

CANCELLATIONS

To comply with the Agreement, it is necessary to cancel any class a minimum of 12 hours before its scheduled time, or the class will be deducted. This policy extends to any changes or substitutions in classes. Cancellations can be made either through our online platform or by contacting the studio directly.

RESERVATIONS

Clients are required to be present at the studio at least 5 minutes before the scheduled class begins to secure their reserved spot, as it may be allocated to a waitlisted client otherwise.

MEMBERSHIP PACKAGES

Clients with active membership packages will incur a penalty charge for late cancellations or no-shows if they fail to cancel their reservation within the specified 12-hour timeframe.

INTRODUCTORY OFFER

New participants are entitled to an introductory discount, limited to one per individual. All promotional offers are non-transferable and non-refundable. Accounts of individuals attempting to exploit the introductory offer multiple times will be suspended, and additional class fees will be charged for any classes already attended under the introductory offer.

WORKSHOP

Cancellation of workshops or events must be made at least 24 hours before the scheduled start time. Failure to attend or cancel within the 24-hour window will result in full charges for the workshop, with no credit available for future use. Workshops, events, and training sessions are non-refundable, and cancellations initiated by students will not receive credit.

7. RETAIL - PRODUCT INFORMATION

All products featured on the website are subject to availability. In the event that the product you have ordered is unavailable, we will promptly notify you via email. Please be advised that certain items showcased on the website may not be accessible in physical stores. We do not guarantee the perpetual availability of any products or services exhibited on the website, neither in terms of time nor location.

The product images displayed on our website are intended for illustrative purposes solely. Our utmost endeavor has been to present the colors of our products on the website as accurately as possible. However, there might be slight discrepancies between the actual products and the images presented. Moreover, the packaging of the products may differ from what is depicted on the website.

8. PURCHASE OF PRODUCTS

Our sales process follows a structured series of steps:

Placing an Order: After a thorough review of product specifics, you can place an order by providing necessary details such as name, address, email, phone number, and chosen payment method on the order summary page. It's imperative to acknowledge the price, shipping charges, Terms of Service, and confirm your commitment to the payment by clicking the 'complete order' button. To place an order with Samsara Yoga Center LLC, a valid credit or debit card issued by an acceptable bank is required, unless using a valid gift card issued by us.

Order Acknowledgement: Upon receiving your order, Samsara Yoga Center LLC will send an email to the provided address. This communication signifies receipt of your order but does not confirm its acceptance.

Order Acceptance: Samsara Yoga Center LLC acknowledges your order by email, detailing the purchase information, Terms of Service, and a cancellation form if needed within 48 hours.

Shipping Confirmation: You will receive a shipping confirmation email once your product leaves our warehouse.

Payment Terms: Prices are listed in AED (United Arab Emirates Dirhams) and include VAT where applicable. Advance notice of shipping costs or additional fees will be provided on the website. Payment is limited to debit or credit cards, with all charges settled beforehand. In case a product becomes unavailable after ordering, you will be promptly informed, and any payments made will be reimbursed to your card.

Security Checks: To prevent fraudulent card use, security checks may be conducted on all orders, possibly including a telephonic confirmation before processing. Order details may be shared with third parties exclusively for fraud prevention.

Sales are tailored for personal use only, not for commercial or resale purposes. We reserve the right to decline orders from non-consumers, supplying products solely for domestic and private use. Any losses related to commercial use are not covered by us.

REFUND POLICY: Unused products can be returned for a full refund within 14 days of purchase, provided a receipt is available.

9. NON-RECORDING OF LIVE STUDIO/ONLINE CLASSES AGREEMENT

By accepting these terms, you acknowledge and consent to the prohibition of recording or transmitting any live classes or activities conducted by Samsara, whether in a physical studio or online, without prior written authorization from a designated representative of Samsara. Please note that Samsara Tribe instructors are not permitted to grant consent for such activities. This restriction encompasses any form of recording or broadcasting, including video, audio, photography, live streaming, or social media sharing, on platforms such as Snapchat, Zoom, Facebook, or Instagram. However, you may record and share lawful, non-offensive content related to your participation in a Samsara Tribe class before or after the session with the explicit consent of each participant featured in your content.

Violation of this non-recording agreement may result in exclusion from participating in any activities offered by Samsara Yoga Center LLC. Additionally, you agree to indemnify, defend, and absolve Samsara Tribe, its officers, directors, employees, agents, and instructors from any claims, lawsuits, or actions, as well as any associated losses, damages, or expenses (including reasonable legal fees), arising from your breach of this non-recording agreement.

10. YOGA CLASSES GUIDELINES

Certain physical conditions and health issues may render practicing yoga unsafe. If you have any of the conditions outlined below, we recommend consulting a doctor or physician before enrolling in a yoga class at Samsara. Furthermore, it is essential to inform your yoga instructor of any recent injuries, surgeries, or health concerns to facilitate modifications that can prevent potential injuries during the practice. It can vary from: Surgery, Inflammation, Wrist condition/injury/pain, Ankle condition/injury/pain, Hip condition/injury/pain, Broken bones, Joint condition/injury/pain, Tendon condition/injury/pain, Ligament condition/injury/pain, Pregnancy, Sciatica, Knee condition/injury/pain, Hernia/Ulcer, Hypertension, Frozen shoulder, Back condition/injury/pain.

Should you have any of the subsequent physical conditions or health issues, we kindly request that you refrain from booking a yoga session to ensure the safety of yourself, the instructor, and fellow participants. In the event that you attend a yoga class with any of these conditions, please be advised that we retain the right to request your departure without rendering the service and withhold the option for a refund. Such as: Contagious diseases, A new or worsening cough, A fever of at least 38°C, Shortness of breath, Sore throat, Sneezing and runny nose, Temporary loss of smell, condition under the influence of alcohol, drugs, or illicit/illegal substances.

11. INTELLECTUAL PROPERTY AND TRADEMARKS

The intellectual property and trademarks of Samsara Tribe, encompassing the content on the Samsara Tribe website, such as text, software, scripts, graphics, photos, music, videos, and interactive features ("Content"), as well as the trademarks, service marks, and logos contained within ("Marks"), are either owned or licensed by Samsara Tribe, and are protected by copyright and other intellectual property laws. The Content on the website is provided solely for personal information and use and may not be utilized for any other purposes without the explicit written consent of the respective owners. Samsara Tribe retains all rights not expressly granted regarding the website and its Content. Your communication of any feedback, suggestions, ideas, or information about the website or services to Samsara Tribe is considered non-confidential and becomes the exclusive property of Samsara Tribe. You are prohibited from engaging in the unauthorized use, reproduction, or distribution of any Content beyond the permitted uses stated herein. Moreover, you agree not to bypass, disable, or disrupt any security features of the website or any features that restrict the use, copying, or access to any Content, or enforce limitations on the use of the website or its Content. The trademarks “Samsara Yoga Center,” “Samsara Tribe,” “Samsara,” and associated graphics, logos, wordmarks, and designs are trademarks of Samsara Yoga in the UAE and potentially in other countries where applications are pending. These trademarks and trade dress of Samsara Yoga Center must not be employed, including within trademarks or domain names, in a manner that may cause confusion with any product or service, and must not be replicated, mimicked, or used, either wholly or partially, without the express written consent of Samsara Yoga Center.

12. TERMINATION

We retain the right to discontinue your access to the Services at our discretion, without cause or prior notice. Likewise, you have the prerogative to end your account or any acquired membership at any time and for any reason via the "My Account" section or by directly contacting Samsara Yoga Center through phone or email. Should you violate the Terms of Service, we reserve the right to terminate your account or membership without advance notice. In the event of termination due to a breach of the Terms of Service, no refunds will be issued for fees paid or any unused portion of memberships or class packages.

13. THIRD PARTY SITES

Third-party links featured on this website may redirect you to external websites that are independent of our organization. It is important to note that we do not assume responsibility for reviewing or assessing the content or accuracy of these third-party sites. Consequently, we do not guarantee or accept liability for any materials, websites, products, or services offered by third parties.

Any damages or issues arising from the purchase or use of products, services, content, resources, or other transactions through third-party websites are not within our liability. Prior to engaging in any transactions, we strongly advise a thorough review of the policies and practices of the third-party involved to ensure a clear understanding.

Should there be any complaints, claims, concerns, or inquiries regarding products from third-party sources, we recommend directing them to the third-party entity in question.

14. MEMBERSHIP ASSIGNMENT

You are prohibited from assigning or transferring your membership, bookings, or any associated rights under this Agreement without obtaining prior written consent. Any such attempted assignment or transfer that does not adhere to the aforementioned requirement will be deemed void. In cases where permitted by relevant laws, we retain the right to freely assign or transfer this Agreement. It is important to note that this Agreement benefits and binds the involved parties along with their legal representatives, successors, and assigns.

15. FEES

You acknowledge that Samsara Yoga Center imposes charges for its services, with the reservation that Samsara Yoga Center retains the right to modify its fees at its discretion. In the event that your membership is terminated by Samsara Yoga Center due to a violation of these Terms of Service, you may not be eligible for a refund of any remaining membership or other fees.

16. GOVERNING LAW

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Dubai, UAE, without giving effect to any principles of conflicts of law.

17. ARBITRATION

You and Samsara Yoga Center concur that, unless otherwise stipulated for specific services on the site under distinct terms related to those services, any disputes or claims arising from or relating to these terms of use, the site, and/or the service (including your usage of the site and/or the service) shall be resolved through final and binding arbitration. However, in cases where there is an infringement or potential infringement of patent, copyright, trademark, or trade secret rights, or a violation of the User conduct rules outlined above, both parties recognize that arbitration may not provide adequate redress, and seek injunctive or other suitable relief.

18. FEEDBACK, USER COMMENTS, AND OTHER SUBMISSIONS

Should you provide specific submissions at our request (such as contest entries) or independently send creative ideas, suggestions, proposals, plans, or other materials, whether through online channels, email, postal mail, or any other means (collectively referred to as "comments"), you thereby consent to our unrestricted right to edit, copy, publish, distribute, translate, and utilize in any medium any comments forwarded to us, at any time. We are not obligated to (1) maintain comments in confidence; (2) provide compensation for any comments; or (3) respond to any comments.

While we reserve the right to monitor, edit, or remove content that we, at our sole discretion, deem unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, objectionable, or in violation of any party's intellectual property rights or our Terms of Service, we are not bound to do so.

By submitting comments, you affirm that they will not infringe upon the rights of any third party, including copyright, trademark, privacy, personality, or any other personal or proprietary rights. You also agree that your comments will not include defamatory, unlawful, abusive, or obscene content, or contain any computer virus or malware that could disrupt the operation of the Service or any associated website. It is prohibited to use a false email address, impersonate another individual, or mislead us or third parties about the origin of any comments. You bear sole responsibility for the accuracy of your comments. We do not accept liability for any comments posted by you or any third party.

19. COMPLETE AGREEMENT AND NO WAVER

The Terms of Service, in conjunction with our Privacy Policy (collectively referred to as the "Agreement"), along with any additional legal notifications disseminated on the Services, constitute the comprehensive agreement between you and us concerning the Services. This Agreement supersedes all preceding terms, agreements, discussions, and documents relating to the Services. In the event that a provision within the Terms of Service is deemed unenforceable, such a determination shall not impact the validity of the remaining provisions, which shall remain fully operational.

Furthermore, the absence of a waiver for any term specified in the Terms of Service will not translate to a waiver of that term or any other term. Our failure to enforce any right or provision under the Terms of Service will not be construed as a waiver of such right or provision.

20. SERVICE INTERRUPTIONS

Our services may experience temporary or permanent suspension without prior notice for reasons such as security measures, maintenance or repairs, system malfunctions, or comparable circumstances, collectively referred to as "Service Interruptions." It is recognized and accepted that no refund or rebate is warranted in connection with these Service Interruptions.

21. INDEMNIFICATION

By using the Services, you agree to release, indemnify, and defend Samsara Yoga Center LLC, including its subsidiaries, affiliates, related companies, suppliers, licensors, partners, and all associated officers, directors, employees, agents, and representatives, from any third-party claims and costs (including reasonable attorneys’ fees) linked to:

Your use of the Services
Your conduct or interactions with other users
Your violation of this Agreement.

We will promptly inform you of any such claim and offer you reasonable support in defending it at your expense. You must allow us to join in the defense and not settle any claim without our prior written approval. We reserve the right to take over the exclusive defense of any indemnified matter at our own cost. In such cases, you are relieved from further responsibility in defending us regarding that matter.

22. LIMITATION OF LIABILITY

By accepting this Agreement, enrolling online, and/or participating in classes, events, activities, and other programs provided by Samsara Yoga Center LLC (“Samsara”), you acknowledge and agree, on behalf of yourself, your heirs, personal representatives, and/or assigns (collectively referred to as “You” and/or “Yourself”), the following:

Inherent risks and dangers are associated with the vigorous nature of Samsara Yoga classes.
You have chosen to participate in the yoga classes voluntarily.
It is strongly advised by Samsara to consult a licensed physician before starting any classes.
You have been duly informed about the intense nature of the exercise program and the potential physiological risks, such as abnormal blood pressure, fainting, heart attack, or death.
You take full responsibility for your health and well-being and release Samsara Yoga Center LLC, its instructors, members, and employees from any liability for injury, harm, or loss, including death resulting from participation in Samsara yoga classes or activities at Samsara Yoga Center LLC premises.

If enrolling a minor (an individual below the age of majority in their jurisdiction of residence), the above release also applies to the minor. Participation is not permitted for individuals under 16 years of age. Minors aged 16-18 may only participate with a parent or legal guardian.
We offer services, including the site and mobile apps, on an "as is" and "as available" basis, without any express or implied warranties. Samsara Yoga Center LLC explicitly disclaims all warranties and conditions, including merchantability, accuracy, uninterrupted service, fitness for a specific purpose, non-infringement, and any warranties arising from course of dealing or trade usage.
We do not guarantee, and we disclaim all liability for:

Products, services, information, programming, or any other content provided by a third party accessible through our services.
The quality or behavior of any third party encountered during your use of the services.

You agree that, to the fullest extent permitted by law, Samsara Yoga Center LLC will not be liable under any theory of liability. This includes, but is not limited to, indirect, incidental, consequential, special, or exemplary damages, loss of profits, business interruption, reputational harm, or data loss (even if foreseeable) arising from your use of, or inability to use, the services.
Some jurisdictions may not allow limitations on implied warranties or exclusions of liability for certain types of damages. Therefore, the aforementioned limitations and exclusions may not apply to you entirely or in part.

23. PANDEMIC LIMITATION OF LIABILITY

Samsara takes the COVID-19 pandemic and any other pandemics seriously and has implemented preventive measures to reduce the spread of COVID-19. However, Samsara cannot guarantee that you, your family, or your guests will not contract COVID-19 or other infectious diseases. Attending classes, events, and activities at Samsara may result in close physical contact with other members, attendees, and staff, potentially increasing the risk of exposure to COVID-19 or other diseases. You acknowledge the contagious nature of COVID-19 and other diseases and willingly accept the risk of exposure or infection at Samsara Studio, understanding that such exposure could lead to personal injury, illness, disability, or even death. The risk of exposure or infection may be attributed to your actions, omissions, or negligence, as well as those of Samsara employees, members, and attendees.

By agreeing to these Terms, enrolling online, or participating in classes, events, activities, or programs at Samsara, either at a Samsara facility or using Samsara equipment, you voluntarily agree, to the extent permitted by law, on behalf of yourself, your heirs, personal representatives, assigns, and any enrolled minor child, to: (a) assume all risks related to COVID-19 and other diseases, taking sole responsibility for any COVID-19-related injury, illness, damage, loss, claim, liability, or expense, including personal injury, disability, or death, that may occur to you or your family members during your time at Samsara Yoga Center; and (b) agree not to bring any claims, including liabilities, actions, damages, costs, or expenses of any kind, against Samsara Yoga Center LLC, its instructors, clients, or employees, arising from or related to COVID-19 infection, regardless of whether it occurs before, during, or after your visit to Samsara studio facilities or participation in Samsara Yoga Classes.

24. SEVERABILITY AND WAIVER

Failure to exercise or enforce any right or provision of the Terms of Service does not waive that right or provision. Should a court of competent jurisdiction find any part of the Agreement unlawful, void, or unenforceable, that specific provision will be considered separate from the Agreement, without affecting the validity and enforceability of the other provisions.

25. NOTIFICATIONS

We reserve the right to deliver notifications to you through various means, including email to your account's primary email address, mobile notifications, hard copies, or postings on our Services, as required or allowed by law. Please note that Samsara cannot be held accountable for any automatic filtering that you, or your network provider, may apply to these notifications.

26. INTERPRETATION

In the interpretation of the Terms of Service, it is important to note that headings are provided for convenience purposes and should not be deemed as substantive elements.
